These Terms of Use ("Terms") are a binding agreement between mowMedia, LLC ("mowMedia," "mowPod," "we," "us," or "our") and you or the organization you represent ("you" or "Customer"). They govern your access to and use of mowPod Studio, our audience-analytics and content-intelligence platform, and the website at www.mowpodstudio.com (collectively, the "Services"). By creating an account, connecting a platform, or otherwise using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
mowPod Studio helps podcasters, creators, and their teams understand and improve their shows. Depending on your plan and the integrations you connect, the Services may ingest show, episode, and video metadata and performance metrics; generate transcripts; produce AI-assisted content analysis, scoring, and reporting; and present dashboards and insights. We may add, change, or discontinue features over time.
You must be at least 18 years old and able to form a binding contract to use the Services, and you must use them for business purposes. You are responsible for the accuracy of your account information, for keeping your credentials confidential, and for all activity under your account. Notify us promptly at info@mowpod.com of any unauthorized use. Account administrators may control access for authorized users within their organization.
As between you and mowMedia, you retain all rights to the shows, channels, feeds, recordings, transcripts, and other data you provide or connect ("Customer Data"). You grant mowMedia a non-exclusive, worldwide license to host, process, transmit, analyze, and display Customer Data solely to provide and improve the Services and as described in our Privacy Policy. You represent that you own or have the necessary rights and permissions to the Customer Data and connected accounts, and that our processing of it as contemplated here will not violate any law or third-party right.
The Services let you connect third-party platforms such as YouTube, Apple Podcasts, podcast hosting providers, and email service providers. When you authorize a connection, you permit mowMedia to access and process data from that platform on your behalf, subject to that platform's terms and to the scope of the authorization you grant. You are responsible for having the authority to connect each account, and you may revoke access at any time through the applicable platform or by contacting us.
YouTube. Certain features use YouTube API Services. By using those features, you agree to be bound by the YouTube Terms of Service, and you acknowledge that Google's use of data is governed by the Google Privacy Policy. You may revoke mowPod Studio's access to your Google/YouTube data at any time via myaccount.google.com/permissions. Our use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.

The Services generate automated analysis, scores, summaries, and recommendations using AI and statistical methods. These outputs are provided for informational purposes, may contain errors or omissions, and are not guarantees of performance or professional advice. You are responsible for how you use them.
If your use of the Services is subject to fees, you agree to the pricing and payment terms presented to you at purchase or in a separate order. Unless stated otherwise, fees are non-refundable, and you are responsible for applicable taxes. We may change fees on a going-forward basis with reasonable notice.
The Services, including all software, models, designs, text, and the mowPod and mowPod Studio names and logos, are owned by mowMedia or its licensors and are protected by intellectual-property laws. Except for the limited right to use the Services under these Terms, no rights are granted to you. We may use de-identified and aggregated data to operate, secure, and improve the Services and to create benchmarks that do not identify you or any individual.
Each party may receive non-public information of the other. The receiving party will use it only to perform under these Terms and will protect it with reasonable care, except where disclosure is required by law.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DATA OR ANALYSIS WILL BE ACCURATE OR COMPLETE. THIRD-PARTY PLATFORMS AND THEIR DATA ARE OUTSIDE OUR CONTROL.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOWMEDIA AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
You will defend, indemnify, and hold harmless mowMedia and its affiliates from claims, damages, and expenses (including reasonable attorneys' fees) arising from your Customer Data, your use of the Services, your connected accounts, or your violation of these Terms or any law or third-party right.
These Terms apply while you use the Services. You may stop using the Services and disconnect integrations at any time. We may suspend or terminate access if you breach these Terms, if required for security or legal reasons, or if we discontinue the Services. Upon termination, your right to use the Services ends; sections that by their nature should survive (including Sections 3, 8–12) will survive.
These Terms are governed by the laws of the State of Connecticut, without regard to its conflict-of-laws rules. The state and federal courts located in Connecticut will have exclusive jurisdiction, and you consent to venue there, except that either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property or confidential information.
We may update these Terms from time to time. If we make material changes, we will post the updated Terms and update the Effective Date. Your continued use of the Services after changes take effect constitutes acceptance.
